Welcome to MemoFigura. These Terms of Service apply to your use of the MemoFigura website and to orders for custom 3D figurines and related keepsakes. By using our website or placing an order, you agree to these Terms.

1. Our products

MemoFigura products are made to order from the photos and instructions you provide. Each figurine is individually designed and produced, so the finished item may have small differences in pose, facial details, color, texture, scale, and packaging compared with product images or the original photo.

Our figurines are keepsakes and display items. They are not toys, medical devices, safety equipment, or a guarantee of an exact photographic likeness.

2. Product information and pricing

We make reasonable efforts to keep product descriptions, images, prices, and availability accurate. We may correct errors or update information before an order is accepted. The price, currency, shipping charge, and any applicable taxes shown at checkout apply to your order unless an obvious pricing error has occurred.

3. Orders and payment

An order is submitted when you complete checkout. An order is accepted when payment is successfully authorized and we send an order confirmation. We may decline or cancel an order if payment cannot be verified, the submitted content is unlawful or infringing, or the requested product cannot reasonably be produced.

You are responsible for providing accurate contact, shipping, and order information. Please contact us as soon as possible if any order information needs to be corrected.

4. Photos and custom instructions

You must have the right and permission to upload every photo, name, likeness, logo, or other material that you submit. You must not upload content that is unlawful, threatening, abusive, hateful, sexually explicit, fraudulent, or infringing.

You give MemoFigura a limited, non-exclusive license to use submitted materials only as needed to review, design, produce, quality-check, support, and deliver your order. We will not use customer photos for public marketing or advertising without separate permission, unless required by law.

5. Production and delivery

All custom figurines are made to order. After your order and photo materials have been received and approved for production, production normally takes 1–2 weeks. This is the production period only and does not include shipping transit time.

Shipping estimates may vary by destination, carrier conditions, customs processing, order volume, and events outside our reasonable control. Shipping methods, charges, and available destinations are shown at checkout or confirmed by email. If a promised shipping time cannot be met, MemoFigura will provide an appropriate update and any cancellation or refund option required by applicable law.

6. Changes and cancellations

Please contact us promptly if you need to change or cancel an order. A cancellation may be possible only before custom production begins. Once design, production, or fulfillment has started, the order may not be cancellable because the item is made specifically for you. Any approved refund is handled under our Return & Refund Policy.

7. Returns, replacements, and refunds

Because our products are custom-made for each customer, we generally do not accept returns or refunds for change of mind, an unsuitable photo, inaccurate customer instructions, approval of a design, or no longer wanting the item after custom production has begun.

If your item arrives with a material manufacturing defect, is materially damaged in transit, is incorrect, or is materially different from the order, please contact MemoFigura as soon as reasonably possible with your order number and clear photos. We will review the issue and, where appropriate, offer a repair, replacement, partial refund, or full refund in accordance with our Return & Refund Policy and applicable law.

8. Intellectual property

MemoFigura and its licensors own the website design, text, graphics, logos, product images, software, and other site materials unless stated otherwise. You may use the website for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, scrape, sell, or exploit our site materials without written permission.

9. Prohibited use

You may not use this website to violate any law, interfere with the website or its security, impersonate another person, submit malicious code, collect information about other users without permission, or upload material that infringes another person's rights.

10. Third-party services and links

Some functions may rely on third-party payment, hosting, shipping, analytics, or customization services. Those services may have their own terms and privacy policies. MemoFigura is not responsible for third-party websites or services that we do not control.

11. Disclaimer and limitation of liability

To the fullest extent permitted by applicable law, the website and its content are provided on an as-available basis. We do not guarantee that the website will always be uninterrupted, error-free, or available in every location. Nothing in these Terms limits consumer rights that cannot legally be excluded.

12. Changes to these Terms

We may update these Terms from time to time. The latest version will be posted on this page with its updated date. Your continued use of the website after an update means you accept the revised Terms.

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Hong Kong.
